The NYC Department of Education has recently announced that parent/guardian consent for COVID-19 testing of students may NOT be a condition of in person learning or other school activities. This was the outcome of a recent court case filed by parents. Does the same law apply to Shen and public schools across NY?

From NYS Department of Education: “School districts may not require parent/guardian consent for COVID-19 testing of students in order for the students to participate in in-person learning or other school activities, unless local health authorities direct schools otherwise. The district cannot require remote instruction for students whose parents/guardians do not consent to surveillance tests for COVID-19, absent a determination by local health authorities.” Visit http://www.nysed.gov/coronavirus for more information.
